In that case you can tell her that we're pulling for her, and that I for one can't even begin to imagine what she must be going through.

Shelley had her court date on the 14th, and all of the criminal charges were dismissed...the prosecution didn't even bother to show up...probably because they knew they didn't have a case and didn't want to look like fools. Her baby is still with his grandparents, as the investigation is still ongoing and there are some more medical tests that the judge wanted to have run, but the judge was also very upset that the babysitter had not been investigated, and ordered the criminal investigation re-opened so that she could be questioned/investigated further.

*deep sigh of relief*

Wonderful news! I'm still embarassed to live in the same county with THAT type of law enforcement. Doesn't make me feel good if I even need to count on them.

So far as they can tell, based on all the tests that have been run, the baby is fine...he has been a happy, healthy boy since he was taken out of the daycare, and he seems to be developing just fine.

Article in local paper

quote:
The Livingston County prosecutor's office dismissed child abuse charges lodged against a Howell Township mother accused of harming her then-9-month-old son.
Prosecutor David Morse said there is "no doubt in our mind" the child "had injuries inflicted on him," but he could not prove that the boy's mother, Shelley Marie Bachman, caused those injuries.

"Subsequent investigation left us with what we felt was insufficient evidence to prove who caused the injuries to the child," Morse said Thursday, noting that police will continue to investigate.

"If an investigation reveals who caused the injury, then we will certainly bring charges at that time," Morse said.
Defense attorney Carolyn Henry declined to comment on the case.

Police had alleged Bachman "made admissions" she physically abused her son, who suffered a fractured ankle, but police declined to provide more details.

The infant's injuries were discovered after the boy was taken to Saint Joseph Mercy Livingston Hospital in Howell, which referred the family to the specialist in August, police said.

Bachman still faces a pending child abuse and neglect allegation in Livingston County Circuit Court's juvenile division. There was a closed-door meeting between the attorneys and Probate Judge Carol Hackett Garagiola on Friday morning, but the nature of those discussions was not disclosed.

Why would the defense attorney not comment? This article is still biased against Shelley...

And I love how there are no comments attached to this article. The first artcile had 2 pages of local idjits who wanted Shelley lynched. Fuking mob mentality.

Carolyn made the decision that she would not be commenting on the case because she didn't want the case to be tried by the press...basically, she didn't want to have both sides spouting off against each other in the paper instead of in court.
